Driver over the limit for Scotland, under for England

A motorist who was eight points over the limit was disqualified from driving when he appeared before the November sitting of Campbeltown Sheriff Court.

Qasim Ali, aged 29, of 23 Almerie Close, Arbroath, admitted driving with a blood-alcohol level of 30 micrograms per 100 millilitres of blood.

The limit in Scotland is 22 and in the rest of the UK it is 35.

Procurator fiscal depute Ewan Nicholson said officers had reason to stop Ali’s car on the A83 near Whitehouse on November 7.

“They could smell alcohol,” the fiscal said.

Ali failed the roadside breath test and was taken to Campbeltown Police Station where the reading was 30.

Defence agent David Cook said his client had been staying at an Airbnb in Kintyre and had a drink the night before.

“He thought he was fit to drive,” Mr Cook said, and he asked the sheriff if Ali could be considered for a place on a drink-driver rehabilitation scheme.

If completed successfully, this will reduce the statutory driving ban of 12 months down to nine.

Sheriff Euan Cameron agreed to this and along with the ban he fined Ali £500 with a £40 victim surcharge.
